AIDS Legal Referral Panel

ALRP is the only institution in the San Francisco Bay Area solely dedicated to providing free and low-cost legal assistance and education on virtually any civil matter to persons living with HIV/AIDS. This includes such widely disparate areas as housing, bankruptcy/credit, immigration, employment, insurance, confidentiality matters, family law, government benefits, and public accommodations. We accomplish this mission through either direct representation of clients by one of ALRP’s staff attorneys or by careful placement of clients with one of ALRP’s 500 panel attorneys. All are welcome to attend the MCLE trainings. Following the training, we hope that non-Panel attorneys will sign up and support ALRP’s mission. There are many benefits to being a Panel attorney and we only ask that Panel members accept two ALRP referrals a year. The State Bar of California has certified ALRP, Provider #2485, to provide MCLE credit for all trainings listed.

Citizenship for Disabled Clients: Navigating the N-648 Medical Waiver

Presented by Brett Snider, Esq. - Jewish Family and Children's Services One of the biggest roadblocks to becoming a U.S. citizen can be demonstrating knowledge of the English language and U.S. history and civics. Learning a new language such as English is difficult under normal circumstances, and it can be near impossible for clients living with certain disabilities. Luckily, clients seeking to naturalize can apply for a medical waiver from these requirements, using Form N-648, Medical Certification for Disability Exceptions. When prepared properly, this N-648 medical waiver can excuse an impaired citizenship applicant from the requirement to speak, read, and/or write in English or to answer questions about U.S. history and civics. However, this form can only be prepared by certain medical and mental health professionals, creating a unique challenge for attorneys who assist clients with these waivers. USCIS has also increased its scrutiny in adjudicating these waivers, making it essential for experienced attorneys to know how to advocate for these waivers at their clients’ naturalization interviews. In this training, we will cover the basics that will allow you to screen for, file, and advocate for medical waivers for your eligible clients who wish to become U.S. citizens. Dissolution Basics

Divorces are a highly emotional time for parties and can be overwhelming to navigate. There are a high number of self-represented parties, so having access to resources, knowing what steps to take, and knowing their rights is especially important. This training will go over the basics of a “simple” dissolution, without custody, including process, forms, and some guidance tips for helping clients, especially those who may not have the means for direct representation or lengthy discovery. This training will cover: • A broad overview of community property law; how property is characterized and divided in a dissolution. • Legal definitions of temporary support and permanent support, the differences, and what to look out for. • Procedural basics from initial filing to final judgment. • Pre-nups and who should have them! A dissolution can negatively affect the health of someone living with HIV/AIDS. By supporting clients through this process, we can have a positive impact on their heath.

Basic Tax Issues for Low-Income Clients

Issues and questions related to taxes can be very stressful for clients and it is incredibly helpful to have an attorney who can provide guidance. Helping a client with a tax-related question is typically a discrete task, rather than one requiring ongoing support. Clients with lower incomes may have questions related to taxes on income and benefits. This MCLE will help attorneys work with their clients to handle these issues as they prepare their federal and state income tax returns. Topics covered include: • Determining a client's filing requirement; • Calculating taxes (if any) on social security and unemployment benefits; • Claiming the earned income tax credit and related credits; and • Applying for payment plans or offers-in-compromise.

Experiencing subtle or overt discrimination and having difficulty securing reasonable accommodation are common for workers living with disabilities. This training will cover Federal and California laws on protections for disabled workers, including reasonable accommodations and the obligations of employers and employees to engage in the interactive process.
